Understanding Social Security Disability Insurance Benefits

[vc_row][vc_column][vc_column_text]Social Security Disability Insurance (SSDI) is a safety-net program that offers benefits to people under the age of 65 who have become disabled or blind. Who can receive Social Security Disability Insurance Benefits? SSDI benefits are available to anyone who is unable to work due to an injury or disease that is expected to last for at least one year or result in death. Federal law has a strict definition for disability. Injuries and conditions that are eligible under SSDI are typically considered life-changing. Do I meet the work requirements for receiving disability benefits? To receive disability benefits, you must pass two different working tests. 1) You must have worked a certain number of years based on the age at which your disability begins; and 2) your income from your working years must meet minimum levels in compliance with SSDI regulations. Some blind workers are only required to pass the first test. How is the decision made to approve SSDI benefits? To be approved SSDI benefits, the Social Security Administration (SSA) will investigate five questions. 1) Are you working? If you are working and have an average monthly income exceeding a certain limit, you are not considered to have a disability. The income limit varies from year to year and is published annually by SSA. If you do not have a job right now, or if your average monthly income is equal to or lower than the current limit, SSA will consider your condition. 2) Is your condition “serious”? Your condition must severely limit your ability to perform basic tasks, such as walking, sitting, or remembering details. The condition must have lasted, or is expected to last, at least one year. If SSA determines that you have a disability, they will take a closer look at your condition. 3) Is your condition listed on the list of serious illnesses? SSA keeps a list of diseases and condition they believe are serious enough to automatically indicate that you are unable to perform work, regardless of age, education, or work experience. If your condition (or combination of conditions) is not specifically on the list, SSA will evaluate whether your condition(s) is as severe as a disease on the list. If SSA determines your condition is equivalent to a serious illness, they will rule that you have a disability. If not, SSA will examine your ability to work. 4) Can you perform your previous work? Does your condition prevent you from working as you did in the past? If your condition does not cause any hindrance, SSA will rule that you are not disabled. If your ability to work is affected, there is one last question to address. 5) Can you engage in any other type of work? If you are unable to do previous work, SSA will consider whether you are still capable of doing other work, even with your condition. They will consider age, education, past work experience, and any skills that may apply to other types of work. If you are unable to perform other types of work, SSA will rule you have a disability. If SSA determines that you can do other work, they will not consider you disabled. Do You Have the Right Type of Car Insurance?

[vc_row][vc_column][vc_column_text]One of the largest question marks in the aftermath of a serious car accident is insurance.  Do you have the right kind of coverage?  Does everyone else?  Is there enough coverage? Will medical bills be paid?  The answers to these questions are determined by your auto insurance coverage.  The Law Offices of Scott Warmuth cannot tell you which insurance options are best for you, but we can tell you about the insurance options available and how each type of coverage could affect you In the event of a car accident. Liability Liability insurance is the only car insurance required by the law.  There are two specific types of liability insurance: bodily injury liability insurance, and property damage liability insurance.  In California, all drivers and vehicles must have a minimum bodily injury liability policy of $15,000 per person/$30,000 per accident and a minimum property damage liability policy of $5,000 per accident. Liability insurance is the most important car insurance, as it is designed to protect others if you cause a car crash.  Liability insurance only applies if you are found at fault for an accident.  If that happens, you are responsible for the other parties’ medical care and property damage, which is what liability insurance covers.  And if you are not found at fault for a car accident but don’t have liability insurance, you are not eligible to receive payments for pain and suffering, drastically reducing your ability to recover financially after a crash. Bottom line is that everyone should have this type of insurance to protect themselves and everyone around them should the unexpected happen.  Driving without liability insurance can result in expensive fines, vehicle impoundment, and a suspension of your license. Medical Payments This type of insurance will pay for medical expenses if you are involved in an accident, regardless of who is at fault.  Medical payment insurance covers an ambulance ride, hospital visits, and diagnostics up to the policy limit. Uninsured/Underinsured Motorist (UIM) While liability insurance is required by law, nearly one in six drivers in California get behind the wheel without it.  If an uninsured driver crashes into your vehicle, it can be very difficult to receive compensation for your injuries and property damage.  UIM insurance makes sure you can treat your injuries and fix your car if you are hit by an uninsured driver. And if your medical bills exceed someone’s insurance policy limits, UIM will make up the difference.  For example, if a driver with $15,000 liability insurance crashes into you and your medical bills are $20,000, UIM insurance will make sure your medical bills are covered.  The Law Offices of Scott Warmuth strongly recommends that drivers obtain UIM insurance. Collision If you are not at fault in an accident, your vehicle repairs are covered by the responsible party’s liability insurance.  But if you are at fault, collision insurance will pay for any damage to your vehicle sustained in an accident.  Collision insurance is usually subjected to a deductible. Comprehensive Comprehensive insurance protects your car from theft and damage sustained that is not the result of a car crash.  When your vehicle is damaged by vandalism, acts of nature, or even rioting, comprehensive coverage will pay for the damage. Emergency Roadside Service If your car becomes disabled, emergency roadside service insurance will tow your car to a repair shop, fix flat tires, jump start your car, retrieve locked keys, and often provide other services.  Your insurance company will have a complete list of services offered. Rental Car If your car is damaged for any reason covered by your insurance company, rental car insurance will pay for a rental car while your vehicle is being repaired.  There is usually a maximum benefit per day and a limit on the number of days you can have a rental. Umbrella Umbrella insurance is essentially extra liability insurance.  Umbrella policies are designed to protect policy holders from extremely large liability claims.  Insurance companies typically will not offer umbrella insurance to policy holders unless they have relatively high levels of liability insurance already.  Umbrella insurance only kicks in after your primary liability coverage has been exhausted and usually covers both auto and homeowners insurance claims. Reducing the Risk of Common Causes of Car Accidents

Drunk Driving Not only is drunk driving one of the most common causes of car accidents, it is also one of the most deadly.  Please do not drink and drive.  Penalties for drunk driving are severe and could land a perpetrator in prison. Distracted Driving Not paying enough attention to the roads is a quick way to cause an accident.  The use of handheld devices while driving is illegal in California due to the dangers it poses.  Talking on the phone without the use of a hands-free setup and texting can lead to fines by law enforcement.  Other examples of distracted driving include things as simple as using a GPS and adjusting the radio station or climate control.  Always do your best as a driver to pay attention to the road. Speeding Driving too fast can cause accidents, and the faster you're going, the more likely a crash is to involve serious injuries.  Pay attention to posted speed limits and always consider the driving conditions. Weather Speaking of driving conditions, rain, snow, and fog can lead to dangerous driving conditions.  Slow down and turn on your headlights!  Wet roads are slippery roads, making it harder to stop a moving car.  Fog limits visibility, making it less apparent that you need to stop.  For inclement weather, be sure to only use your low beams and fog lights.  High beams, or brights, will actually harm your visibility and poses a danger to other drivers. Not Following Traffic Instructions Many crashes happen because a driver ignores traffic signals or other posted signs.  Many times these types of accidents occur in conjunction with drunk or distracted driving as well.  Every driver should know that a red light means stop, but if you're reading a book while driving you might not notice the red light coming up.  Following the rules of the road can prevent many of these types of accidents.
